FUTO Land Dispute: Anukam, Land Grabbers, Disgraced …As Court Affirms FUTO’s Ownership

The tide finally and legally turned against Mr Sam Anukam and Ors as they are disgraced as illegal occupants, land grabbers and encroachers by a recent court judgment at the Imo State High Court, Portharcourt Road, Owerri.

The over six years legal fireworks ignited by Mr Sam Anukam, against both the Federal and Imo State government, its agencies and private partners, that include but not limited to Federal University of Technology Owerri (FUTO) and Orient Garden City among others, over the legitimate owners of the embattled FUTO land, has been extinguished by the landmark judgment delivered by Hon Justice K.K Orjiakor against the plaintiff, Sam Anukam and ors.

Consequently, upon careful consideration of the suit, and with the Statement of Claim, Witness Depositions, Statement of Defence and other processes filed, thereto and the defence of the defendants and after considering the evidence of the Claimants and
Defendants, the court holds that the case of the Defendants succeeds as the rightful owner of the land in question.

Delivering the judgment, Hon Justice Orjiakor averred that Sam Anukam and ors were incompetent in filing the matter and dismissed the suit totally as an abuse of court process, as court records have it that the same suit has been earlier handled and judgment delivered by Hon Justice Njemanze.

Another straw that broke the plaintiff camel’s back which should be considered the import of the judgment, was that the said Sam Anukam as an attorney cannot sue in his behalf because those communities he claims to represent are non juridic persons, they have to nominate someone to sue on their behalf and not him (Anukam) suing in his own name.

Speaking to the newsmen after the judgment both the counsel to Orient Garden City Limited Barr Stanley U Okwara PhD and the Public Relations Officer (PRO) of FUTO Mrs Joy Nnodi on behalf of their Establishments expressed satisfaction on the judgment.

Speaking further, Barr Okwara PhD averred that one of the major significance of the judgment will be the return of peace and conducive atmosphere and environment for all defendants to be focused on their primary assignments of securing and developing all FUTO lands for the collective benefits of both Students, Management, host communities and the general public.

Every effort to get the response of the Plaintiff or their representatives proved abortive as neither Sam Anukam nor his representing counsel, Barr LUN Nwakaeti was noticed within the court premises.
