Appeal Court Postpones Judgment In Mark, Aregbesola’s ADC Leadership Dispute

The legal battle over control of the African Democratic Congress (ADC) has been prolonged after the Court of Appeal in Abuja postponed judgment on an appeal challenging the protection of state party executives from dissolution.

The appellate court had scheduled Wednesday to deliver judgment in the appeal filed by the ADC, Senator David Mark and former Osun State Governor Rauf Aregbesola, but shifted the ruling to Monday, 13 July 2026.

The postponement was announced after lawyers, journalists and politicians had waited for more than two hours. No reason was given for the decision.

The appellants are challenging a Federal High Court judgment delivered by Justice Joyce Abdulmalik, which stopped the party leadership from dissolving ADC State Working Committees before the expiration of their four-year tenure.

The dispute arose after ADC state chairmen challenged the authority of the party’s Caretaker/Interim National Working Committee to dissolve state executives, appoint congress committees and conduct state congresses.

The plaintiffs argued that such actions violated the 1999 Constitution and the ADC constitution, while the Federal High Court subsequently set aside the planned dissolution of the state executives.

Dissatisfied with the ruling, Mark, Aregbesola and other appellants approached the Court of Appeal, alleging a miscarriage of justice and seeking to overturn the lower court’s decision.

The outcome of the appeal could have significant implications for the ADC’s internal leadership structure and control of its state organs.
